1. Scope of Application

These Terms apply to all services provided by Catapult Smart Media, operating as Catapult – The New Munchies Art Club.

By submitting materials or entering a paid collaboration, you agree to these Terms.

2. Service Categories

2.1 Artist in Focus – Free Web Archive

Free curatorial submission.

If selected:

• Web publication only.
• Social media and newsletter inclusion remain at our sole discretion.

Submission does not establish a contractual right to publication.

2.2 Artist Collaboration – Paid Editorial Production

Includes:

• Professional editorial article
• Permanent web publication
• SEO/GEO optimization

Social media distribution and newsletter inclusion may be included depending on editorial planning, timing, and platform strategy.

Multi-platform visibility is not automatically guaranteed unless explicitly agreed in writing.

2.3 Exhibition Submission – Free Curatorial Review

Free submission for galleries, institutions, artists, and curators.

Selection is entirely curatorial.

If selected, Catapult may propose a Gallery Partnership.

No payment is required unless a partnership agreement is confirmed.

2.4 Gallery Partnership – Paid B2B Collaboration

Gallery Partnerships include professional editorial production and distribution.

Available formats:

a) Exhibition Cover + Social Media Promotion
€180 single / €480 bundle

b) Artist Editorial Feature + Social Media Collaboration
€180

c) In-Depth Artist Interview (published under gallery context)
€450

Details of included platforms and distribution are defined per agreement.

3. Editorial Independence

All selections remain curatorial.

We reserve the right to decline submissions or partnerships.

Platform selection and distribution channels are determined solely by Catapult Smart Media.

4. Pricing & Payment

Payment is required in advance for confirmed paid collaborations.

No payment is required for free submissions.

Reverse-charge applies where applicable (valid VAT ID required).

No refunds after production has begun.

5. Production Workflow (Paid Collaborations Only)

Applies exclusively to confirmed paid collaborations.

Free submissions do not follow this workflow unless upgraded to a paid partnership.

6. Platform & Distribution Policy

Free selections include web publication only.

Paid collaborations may include multi-platform distribution across:

• Website
• Instagram
• Bluesky
• TikTok
• YouTube
• Substack
• Newsletter

Publication on one platform does not create an obligation to publish on others unless agreed.

7. No Performance Guarantee

We do not guarantee:

• Reach
• Engagement
• Followers
• Sales
• Press coverage
• Collector inquiries

We provide editorial visibility, not performance-based marketing.

8. Intellectual Property & Image Rights

Submitters guarantee that they hold all necessary rights for submitted materials.

By submitting materials, the submitter grants Catapult Smart Media a non-exclusive, worldwide, royalty-free license to publish, distribute, archive, and promote the materials across website, social media platforms, newsletters, and digital channels.

We do not pay licensing fees, copyright fees, or usage fees for submitted materials.

The submitting party fully indemnifies and holds harmless Catapult Smart Media against any claims arising from copyright or image rights disputes.

We reserve the right to remove content if legal concerns arise.

9. Limitation of Liability

We are not liable for indirect, economic, reputational, or consequential damages.Liability is limited to cases of intentional misconduct or gross negligence.

10. Force Majeure

We are not liable for platform outages, algorithm changes, or third-party technical failures.

11. Non-Exclusivity

Services are non-exclusive.

We may feature similar artists, galleries, or projects.

12. Governing Law

Austrian law applies.
Jurisdiction: Vienna, Austria.
Contractual partner: Catapult Smart Media.
