Terms and Conditions (AGB)

1. Scope of Application

1.1. These Terms and Conditions (“Terms”) apply to all services provided by Munchies Art Club / Catapult (“we”, “us”).
1.2. By using our services, you (“the Client”) accept these Terms in full.
1.3. Deviations from these Terms require written confirmation by us.

2. Services

We offer curated digital visibility, editorial services, and media partnerships for artists, galleries, and institutions. Our services include:

2.1. Artist Portraits (B2C)
Curated editorial portraits for individual artists including social media promotion and long-term online discoverability.

2.2. Gallery Artist Features (B2B)
Editorial features developed in collaboration with galleries, including collaboration tags, gallery visibility, and dedicated gallery tag pages.

2.3. Gallery Bundles
Three-artist feature packages for galleries (B2B).

2.4. Backlinks & Indexing
SEO-optimized article pages, artist and gallery tag pages, and long-term indexing across our ecosystem.

2.5. Newsletter Placement
Editorial visibility in our curated newsletter, depending on format and availability.

2.6. Social Media Promotion
Instagram posts, story packages, scheduling, and collaboration tags (Artist + Gallery + Munchies Art Club).

2.7. Ask Kurt Submissions
Free submissions. No open calls. No guaranteed selection. All selections are fully curatorial.

2.8. Consulting
Social media and visibility strategy advice.

3. Terms of Use

3.1. Services are delivered according to the current service descriptions.
3.2. Ask Kurt submissions do not guarantee selection. There is no entitlement to a feature.
3.3. Clients must provide accurate, complete, and legally usable materials.
3.4. Work will only begin once all required materials have been received.
3.5. We reserve the right to decline any project that does not align with our curatorial vision.

4. Pricing

4.1. Artist Portrait (B2C)

  • 2025: €99 (VAT included)
  • 2026: €120 (VAT included)

4.2. Gallery Feature – Package 1 (B2B)

  • Founding Round 2025–2026: €250 (excl. VAT / reverse charge where applicable with valid VAT Number)
  • Regular Price: €350 (excl. VAT / reverse charge where applicable with valid VAT Number)

4.3. Gallery Bundle (3 Artists)

  • €600 (excl. VAT / reverse charge where applicable with valid VAT Number)

4.4. All prices are per feature unless otherwise stated.

5. Payment

5.1. Payment is required in advance.
5.2. Production begins only after full payment has been received.
5.3. Accepted payment methods: bank transfer, Stripe, or agreed alternatives.
5.4. Late or missing payments may suspend or cancel the service.

6. Production Workflow

Every project follows the same structured process:

  1. Requirements List is sent.
  2. Payment is received.
  3. Editorial work begins.
  4. Within 5–7 days:
    – Research
    – Writing
    – Social media planning
    – First draft is delivered
  5. One revision round
  6. Final approval
  7. Scheduling & publication
  8. Indexing + backlinks + gallery tag page (if part of the package)

7. Service Inclusions

Each feature includes:

  • Curated editorial article (length depends on package)
  • One draft and one revision
  • One Instagram carousel post
  • Story package
  • SEO indexing
  • Backlink to artist or gallery (B2B)
  • Long-term discoverability
  • No guaranteed reach or sales

8. What Is NOT Included

The following are not part of any standard package:

  • Press releases
  • Exhibition reviews
  • Copy-paste promotional text
  • Reels or video formats
  • Additional drafts
  • Layout, style, or design adjustments
  • Rewriting the article after publication
  • Replacing images after publication
  • Guaranteed inclusion in the newsletter
  • Social media edits after posting

These can be added via additional services.

9. Add-ons

Additional services can be booked:

  • Extra revision: €40
  • Article update after 9+ months: 70% of original fee
  • Removal of all content: €50
  • Additional Instagram post: €25
  • PDF version of article: €25
  • Priority delivery within 48 hours: €50
  • Replacing more than 5 images: €10 per image

10. Termination & Refund Policy

10.1. Termination by Munchies Art Club

We may end a project at any time if collaboration becomes impossible (conflicts, inappropriate behaviour, unreasonable demands).
→ In this case, 90% of the payment will be refunded.
10% is kept as a service and administrative fee.

10.2. Termination by the Client

  • Before editorial work begins: 90% refund
  • During editorial work: 50% refund
  • After completion or publication: no refund

11. Removal of Published Content

Clients may request removal of their feature at any time.

  • Removal fee: €50
  • Content will be removed from website, Instagram, newsletter archives (where technically possible) within 7 business days.
  • No refund of the original project fee.
  • Removed content will not be provided as files or downloadable copies.

12. Updates After Publication

  • Minor factual corrections: free
  • Substantial updates (new artworks, new text, new biography):
    → 70% of the original feature price
    → No new social media posts
    → No newsletter re-inclusion

13. Creative Control

13.1. We maintain editorial and creative authority over:
– article structure, tone, selection of works
– social media formatting, layout, captions
– publication timing
13.2. Client wishes may be considered but are not binding.
13.3. Final editorial decisions rest with us.

14. Intellectual Property

14.1. All content created by us (text, graphics, design) remains our intellectual property unless explicitly agreed otherwise.
14.2. Clients may share or repost our content with credit.
14.3. Commercial reuse (e.g. for press kits) requires written permission.
14.4. Clients guarantee all submitted material is free of third-party rights.

15. Data Protection

We operate in compliance with GDPR.
Personal data is only used for project execution and deleted after completion.
Clients may request deletion of their data at any time.
Data will not be shared or sold.

16. Governing Law & Jurisdiction

These Terms are governed by Austrian law.
Exclusive jurisdiction is Vienna, Austria.

17. Final Provisions

Invalid clauses do not affect the validity of the remaining Terms.
We may update these Terms at any time; updates will be announced before taking effect.
